Psychiatric evaluation of suspect in assault of Jewish man at Montreal park has been completed

A Quebec Court judge received a report Friday on the psychiatric evaluation of the man charged last month with assaulting a Jewish man at a park in Parc-Extension.

The 30-day evaluation was ordered in August after Sergio Yanes Preciado, 24, was charged with assault causing bodily harm. On Aug. 8, the victim was assaulted in front of his young children at Dickie-Moore Park. The assault was recorded on video and posted on social media.

While the victim is seen lying injured on the ground, the assailant tossed what appears to be a kippah into a puddle of water in a splash pad.

On Friday, Quebec Court Judge Joëlle Roy said she received the report on the 30-day evaluation to determine whether the accused can be found criminally responsible for his actions.

The hearing was inside a courtroom along with dozens of other cases on the role for Friday. Roy was careful to only make vague references to the evaluation. She said the court would not have the required time Friday afternoon to hold a full hearing on the report’s conclusions. She agreed to schedule the hearing for Monday.

“I have read the report completely. What I think is that the victim in the case has an interest in reading it,” Roy said, asking a prosecutor if she could authorize this. “(The report) is very complete and there is a dimension to it that is important to the victim.”

The 30-day evaluation was requested after Yanes Preciado underwent a quick evaluation by a criminologist at the Montreal courthouse on Aug 13.

The criminologist’s report was placed under a seal, but the Quebec Court judge who ordered that Yanes Preciado be sent to the Philippe Pinel Institute revealed some of its findings in open court.

The criminologist wrote that Yanes Preciado struggled after losing his job at a theatre months ago. He consumed drugs, and his mother confirmed he appeared to be experiencing mental health problems.

The judge also said the criminologist wrote that the hot weather experienced in Montreal on the day in question may have played a role in what happened.
