Lululemon accuses Costco of selling ‘dupes’ of its products

Lululemon has filed a lawsuit against Costco, accusing the megaretailer of selling “dupes” of its popular athletic wear that were so similar they may cause “confusion, mistake, and deception” among its consumers.

The complaint, filed in the U.S. District Court for the Central District of California, lists a series of allegedly offending Costco products — among them yoga jackets, hoodies and athletic pants. Lululemon claims Costco infringed on its trademark and patents on the items.

The athleisure brand also alleges that one of the bulk supplier's purposes in selling the items is to “confuse" its customers into believing they are authentic Lululemon products. The company said Costco has not attempted to "dispel the ambiguity."

The clothing company cited articles by The New York Times and The Washington Post that analyzed whether certain Costco items were “dupes” of Lululemon products at a dramatically lower price point.

Costco did not immediately return a request for comment. 

In a statement to CNN, Lululemon said “we take the responsibility of protecting and enforcing our intellectual property rights very seriously and pursue the appropriate legal action when necessary.”

The athletic brand is seeking a jury trial and has asked the retail giant to stop selling the products. The company is also seeking an unspecified amount in monetary damages.

Lululemon previously sued Peloton in 2021, claiming the exercise bike company was selling “copycat products” of its bra line. The two companies ultimately settled, with Peloton agreeing to phase out certain designs.

Two years later, the companies announced a five-year partnership that included Lululemon becoming Peloton's primary athletic apparel partner.
